This document relates to the sale of a parcel of land called Halstead’s Croft and part of a field attached to Halstead’s Farm. This was situated on the left of Halstead Lane, Barrowford, (opposite the Park News agency) from above what is now the East Lancs Towel Company, up to the Old Methodist Chapel (now Dorset House).The land now holds a row of back-to-back cottages, one side called James Street and the other Baldwin Street (after James Baldwin). I am not sure if the land purchase included the houses or if the purchasers developed the land. The row of houses below this row is called Grimshaw Street (after James Grimshaw). This row appears to me to date from the 1890s indicating that the purchasers noted in the document developed the land.
The land belonging to the Independent Methodist Chapel, as described in the document, was below the Old Chapel near James Street – it is not now commonly known that this actually was a chapel. The house above this, known as Aubern House, dates to 1869 and was the Minister’s house. In 1881 the Primitive Independent Minister here was a Philip S Yarker from York.
As far as I can ascertain (as a none-attorney) James Baldwin purchased this land, on a mortgage of £500 with 1% interest at £5 per annum, from William Midgely, of Wood End, Salterforth, and William James Carr of Langroyd. In 1873 James Grimshaw appears to have settled this mortgage.
At the time of this deed James Baldwin, Cabinet Maker, unmarried, lived with his sister, Catherine Lord, on Water Street in Barrowford.
There were two James Grimshaws in Barrowford at this time, both Stone Masons – one lived at Higherford and the other on Halstead Lane. The Grimshaw families were the ‘Barons of Barrowford’ and owned much of the land between Lowerford and Blacko. There is an excellent site covering the Grimshaw families on the internet, which a search under Grimshaw will soon find.
William Midgely, of Salterforth, could (I have not proved this link) have been related to Betty Midgely who was born in Barnoldswick in 1843 and was the landlady at the White Bear, in Barrowford, for a number of years around the 1870/80s.
James Baldwin and James Grimshaw appear to be either selling, or leasing, the land in question to three local notaries - Thomas Thornber England of Heirs House, Colne, Robert Shaw of Colne Hall and Henry Pickles, Draper of Colne Waterside (see the topic ‘Pickles Family’ in Local History forum).
Forest of Pendle
The Halmote Court of the Most Noble Walter Francis Duke of Buccleuch and Queensbury of his Forest of Pendle within the manor of Ightenhill in the County of Lancaster holden at Higham the twenty first day in October in the forty sixth year of the reign of our sovereign Lady Queen Victoria over the United Kingdom of Great Britain and Ireland and in the year of our Lord one thousand eight hundred and eighty two before Arthur Ingram Robinson gentleman Steward there:-
BE IT REMEMBERED that on the eighteenth day of July one thousand eight hundred and eighty two in consideration of one hundred pounds sterling to William Midgely of Wood End in Salterforth in the County of York gentleman surviving mortgagee of the hereditaments and premises hereinafter described and intended to be hereby surrendered under and by virtue of a certain mortgage surrender bearing date of the fifth day of March one thousand eight hundred and seventy three (and upon which admittance was granted on the twenty sixth day of April following) made and passed by James Baldwin then and now of Barrowford in the Forest of Pendle in the County of Lancaster Cabinet Maker to the use of the said William Midgely and William James Carr of Langroyd near Colne in the said County of Lancaster gentleman (since deceased) their heirs and assigns forever subject to the intent proviso or agreement thereunder written for securing the payment of five hundred pounds and interest thereon after which the rate of five pounds per centum per annum on or before the signing and passing hereof paid by James Grimshaw of Barrowford aforesaid Stonemason by the direction of the said James Baldwin testified by his joining in this surrender (the receipt thereof and that the same is in part discharge of all principal and interest moneys due and owing to him in the aforesaid surrender the said William Midgely doth hereby acknowledge and therefrom doth release as well the said James Baldwin as also the said James Grimshaw and the said hereditaments and premises hereby intended to be surrendered).
AND ALSO in consideration of twenty seven pounds eight shillings to the said James Baldwin at the same time paid by the said James Grimshaw (the payment and receipt in manner aforesaid in which said several sums of one hundred pounds and twenty seven pounds eight shillings (making together the purchase money of one hundred and twenty seven pounds eight shillings) he the said James Baldwin doth hereby acknowledge and from the same doth hereby release the said James Grimshaw his heirs executors administrators and assigns and also in consideration of five shillings each at the same time paid by Thomas Thornber England of Heirs House near Colne aforesaid esquire Robert Shaw of Colne Hall in Colne aforesaid Esquire and Henry Pickles of Colne aforesaid Draper to the said William Midgely and James Baldwin respectively at the request and at the direction of the said James Grimshaw testified by his signing hereof (the receipts whereof are hereby respectively acknowledged). HE the said William Midgely (as such surviving Mortgagee as aforesaid) at the request and by the direction of the said James Baldwin:
AND ALSO he the said James Baldwin (and as to both of them at the request and by the direction of the said James Grimshaw testified aforesaid) DO and each of them DOTH hereby and by a rod out of court surrender and give up into the hands of the Lord of the said Forest by the hands and acceptance of James Carr gentleman and customary tenant of the said Forest and sworn according to the custom thereof ALL that plot piece or parcel of land situate in the Township of Barrowford aforesaid part of a close of land called Halstead’s Croft and parcel of Farm there called Halstead’s bounded on the northerly side thereof by property belonging to Levi Duckworth (measuring on that side fifty seven feet five inches or thereabouts) on the southerly side thereof by land belonging to Thomas Holt (measuring on that side sixty five feet nine inches or thereabouts) on the easterly side thereof by Halstead Lane (measuring on that side fifty six feet or thereabouts) and on or towards the west in an irregular line by land belonging to the Trustees of the Independent Methodist Chapel there (and measuring on that side forty nine feet ten inches or thereabouts) and containing in the whole three hundred and sixty four superficial square yards or thereabouts be the same more or less and which said plot of land is of the apportioned yearly copyhold rent to the Lord of the said Forest of one penny TOGETHER with all and singular buildings outbuildings ways roads rights members easements privileges advantages and appurtenances to the said plot of land belonging or appurtaining
AND ALL the estate right title interest property claim and demand of the said William Midgely and James Baldwin and each of them therin and thereto TO THE USE AND BEHALF of the said Thomas Thornber England Robert Shaw and Henry Pickles their heirs and assigns for ever according to the custom of the said Forest by and under the rents suits and services thereof due and of right accustomed according to the custom thereof IN TRUST nevertheless for the said James Grimshaw his heirs and assigns forever freed and absolutely discharged from the said mortgage surrender and all claims and demands in respect thereof:
AND THEREUPON come the said Thomas Thornber England Robert Shaw and Henry Pickles by William Boothman their attorney and desire to be admitted to their fine PROCLAMATION thereof being made and no person forbidding the same then the said premises with the appurtenances are granted by the said steward to the said Thomas Thornber England Robert Shaw and Henry Pickles TO HAVE AND TO HOLD to them their heirs and assigns for ever according to the custom of the said Forest IN TRUST nevertheless for the said James Grimshaw and his heirs and assigns forever YIELDING AND PAYING therefore yearly to the Lord of the said Forest and to his heirs the rents and services therefore formerly due and of right accustomed and now they give to the said Lord for fine one penny by the pledge of Thomas Pollard Gentleman:-
